Republican Rep. Nancy Mace of South Carolina has introduced legislation that would ban men from using women's restrooms in the U.S. Capitol.
Mace has acknowledged that the bill is aimed at Sarah McBride, a Democrat from Delaware who in January will be sworn in as the first openly transgender member of Congress.
The legislation, introduced by Mace on Monday, states: “A Member, Delegate, Resident, officer or employee of the House may not use a single-sex facility (including a restroom, changing room or locker room) in the Capitol or House Office Buildings, other than those corresponding to the biological sex of such individual.”
The rule would be enforced by the Sergeant-at-Arms, according to the legislation.
Responding to accusations online that the bill was targeting McBride, Mace responded, “Yes and then some.”
“Also, Sarah McBride doesn’t get a say here,” Mace said. “I will always protect women and girls.”
House Speaker Mike Johnson reportedly backs Mace's legislation.
“He said there’s not going to be any biological men using our restrooms,” Georgia Republican Rep. Marjorie Taylor Greene told Politico.
Mace confirmed Greene’s account, telling Axios that Johnson “said to me last night that he would include it in House Rules.”
The majority party generally negotiates the rules package for each Congress internally before an up or down vote on the House floor, which usually breaks on party lines.
If Johnson does not address Mace’s concerns through the rules package for the upcoming Congress, she could force a House floor vote on her resolution, requiring each member to publicly record a vote.
McBride responded to the bill by calling it “a blatant attempt from far right-wing extremists to distract from the fact that they have no real solutions to what Americans are facing.”
